Please read these Terms and Conditions carefully before enrolling in any Capitaliq program or using our website. By accessing our website or registering for a program, you agree to be bound by these terms. If you do not agree, please do not use our services.
1. Definitions
In these Terms and Conditions, the following definitions apply:
- "Capitaliq" refers to the financial education provider operating at 19 Jalan Stonor, 50450 Kuala Lumpur, Malaysia.
- "Program" refers to any structured educational course offered by Capitaliq, including Financial Literacy for Educators, Loan Comparison & Evaluation Skills, and Financial Readiness for Home Ownership.
- "Participant" refers to any individual who registers for and/or attends a Capitaliq program.
- "Website" refers to the Capitaliq website accessible at capitali.biz.
- "Program Materials" refers to all content, documents, templates, guides, slides, and resources provided to Participants during or in connection with a Program.
- "Fees" refers to the program registration fee payable by the Participant as specified at the time of registration.
2. Acceptance of Terms
By accessing the Website or completing a program registration, you confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding agreement
- You have read and understood these Terms and Conditions
- You agree to be bound by these Terms and Conditions
If you are registering on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.
3. Program Enrolment
Enrolment in a Capitaliq program is subject to the following conditions:
- Registration must be completed via the designated process communicated by Capitaliq (including contact form, email confirmation, or registration link)
- Enrolment is confirmed only upon receipt of full payment or a written payment arrangement agreed in advance with Capitaliq
- Capitaliq reserves the right to decline or cancel any enrolment at its sole discretion, including where cohort capacity has been reached or where eligibility requirements are not met
- Program cohort sizes are limited. Enrolment is offered on a first-come, first-served basis unless otherwise communicated
4. Fees and Payment
4.1 Program Fees
The program fees as at the date of registration are:
- Financial Literacy for Educators: RM 2,000
- Loan Comparison & Evaluation Skills: RM 1,600
- Financial Readiness for Home Ownership: RM 3,400
All fees are quoted in Malaysian Ringgit (MYR) and are inclusive of all program materials. Fees are subject to change for future cohorts. The fee applicable to your enrolment is the fee confirmed at the time of your registration.
4.2 Payment Terms
- Full payment is due within 7 business days of receiving a registration confirmation, unless an alternative arrangement has been agreed in writing
- Accepted payment methods will be communicated at the time of registration
- Receipts will be issued upon receipt of cleared payment
- Capitaliq does not offer instalment plans as a standard arrangement. Any exceptions must be agreed in writing prior to the commencement of the program.
5. Cancellation and Refund Policy
5.1 Cancellation by Participant
- 14 or more calendar days before program commencement: Full refund of the program fee, less an administrative processing fee of RM 150.
- 7 to 13 calendar days before program commencement: 50% refund of the program fee.
- Fewer than 7 calendar days before program commencement: No refund is available. The Participant may, subject to availability, transfer their enrolment to a future cohort of the same program, provided written notice is given at least 48 hours before the program start date.
- After program commencement: No refund is available once the program has begun.
5.2 Cancellation by Capitaliq
In the event that Capitaliq cancels a program before it commences, enrolled Participants will receive a full refund of the program fee paid. Capitaliq's liability in such circumstances is limited to the refund of fees paid and does not extend to any other losses incurred by the Participant (including travel, accommodation, or related expenses).
5.3 Rescheduling by Capitaliq
Capitaliq reserves the right to reschedule a program due to circumstances beyond our control. In such cases, enrolled Participants will be offered the option to attend the rescheduled cohort or receive a full refund.
5.4 Refund Processing
Approved refunds will be processed within 14 business days of the cancellation request being accepted, using the same payment method used for the original transaction where practicable.
6. Program Delivery
- Capitaliq delivers programs in English. Participants are expected to have sufficient English proficiency to engage with program materials.
- Programs are delivered over the specified number of weeks, with sessions conducted at times communicated to enrolled Participants.
- Attendance is the responsibility of the Participant. Capitaliq does not guarantee that recordings or session notes will be provided for missed sessions, though facilitators may provide supplementary support at their discretion.
- Capitaliq reserves the right to modify program content, session structure, or facilitators where reasonably necessary, provided that the core learning outcomes remain substantially the same.
- Where programs include online or digital delivery components, Participants are responsible for ensuring they have the necessary equipment and internet connectivity.
7. Educational Disclaimer
Capitaliq programs are designed to provide financial education and improve participants' financial understanding. The following limitations apply:
- Nothing in any Capitaliq program, website content, or program material constitutes financial advice, investment advice, legal advice, or any other regulated advisory service as defined under Malaysian law.
- Capitaliq is not licensed as a financial adviser or investment adviser under the Capital Markets and Services Act 2007 or the Financial Services Act 2013.
- Program content is provided for educational and informational purposes only. Participants are solely responsible for any financial, legal, or commercial decisions they make following participation in a program.
- Capitaliq does not endorse, recommend, or refer Participants to any specific financial product, bank, property developer, insurance provider, or investment.
- The financial information presented in programs reflects general principles and publicly available data. Individual circumstances vary and Participants should seek independent professional advice tailored to their specific situation before making significant financial decisions.
8. Intellectual Property
All program materials, including but not limited to curriculum guides, templates, worksheets, slides, and written content, are the intellectual property of Capitaliq or its licensors and are protected under applicable Malaysian and international copyright law.
- Participants are granted a personal, non-exclusive, non-transferable licence to use program materials for their own private educational use.
- Participants may not reproduce, distribute, sell, publish, share publicly, or create derivative works from program materials without prior written consent from Capitaliq.
- Facilitating or enabling the unauthorised sharing of program materials with non-enrolled individuals may result in termination of access to current and future programs without refund.
9. Participant Conduct
Participants are expected to engage with Capitaliq programs in a respectful and constructive manner. The following conduct will not be tolerated:
- Harassment, discrimination, or abusive behaviour directed at facilitators or other participants
- Disruption of program sessions in a manner that interferes with other participants' learning
- Recording of program sessions without prior written consent from Capitaliq
- Misrepresentation of identity or qualifications during registration
Capitaliq reserves the right to remove a Participant from a program without refund if their conduct materially disrupts the program or violates these terms.
10. Website Use
The Capitaliq website is provided for informational purposes. You may use the website for personal, non-commercial purposes subject to these terms. You agree not to:
- Attempt to gain unauthorised access to any part of the website or its underlying systems
- Use the website to transmit spam, malware, or unsolicited commercial communications
- Reproduce, copy, or redistribute website content without prior written consent
- Use automated tools to scrape or collect data from the website
The website is provided "as is" and Capitaliq makes no warranty as to its continuous availability or freedom from technical errors.
11. Limitation of Liability
To the fullest extent permitted by Malaysian law:
- Capitaliq's total liability to any Participant in connection with a program shall not exceed the total program fee paid by that Participant for the program giving rise to the claim.
- Capitaliq shall not be liable for any indirect, consequential, or special loss, including loss of income, loss of opportunity, or loss arising from financial decisions made by a Participant following participation in a program.
- Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
12. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
In the event of a dispute, both parties agree to attempt to resolve the matter through good-faith negotiation before commencing formal legal proceedings.
Consumers who are not satisfied with Capitaliq's response to a complaint may also approach the Tribunal for Consumer Claims Malaysia (Tribunal Tuntutan Pengguna Malaysia) where their claim falls within the jurisdiction of that Tribunal under the Consumer Protection Act 1999.
